Terms of Service

The service

Agentic Build helps you create and edit software projects (often web apps) with an AI agent, optional live preview for simple static sites, and tools to save or open folders on your computer. Features may change as we improve the product. Durable project files are intended to live on your local drive (Save to folder, Download ZIP, or desktop “open folder” / linked folder). We do not guarantee cloud backup or long-term hosting of your project trees.

Accounts

You must provide accurate account information and keep your credentials secure. You are responsible for activity under your account. Free plans require you to supply your own LLM API keys where applicable. Pro ($20/month, when billed) may use our AI capacity subject to fair use.

Bring-your-own API keys

If you use BYO models, you authorize Agentic Build to store and use your API key on the device running the app so it can call third-party AI providers on your behalf.

• Keys are stored locally and encrypted at rest on the machine running the app. You are solely responsible for securing that device, backups, and any copies of settings files.
• You must only use keys you are allowed to use, and you should revoke or rotate keys if the device is lost, shared, or compromised.
• Prompts, code, images, and other content you send may be transmitted to your chosen AI provider. Their terms and privacy policies govern that processing. We are not liable for provider outages, billing on your API account, data retention by the provider, model errors, or misuse of your key.
• Do not submit secrets you cannot afford to expose to a third-party model provider (passwords, private keys, regulated data, etc.) unless you accept that risk.

Your content & ownership

You own the apps and files you create. You grant us a limited license to process content as needed to run the product for you (including the agent and preview) on the systems you use. You must not use the service for illegal content, malware, abuse, or to violate others’ rights. You are responsible for backing up your work to your own disk or repositories; temporary working copies may be lost if you do not Save to folder / export.

AI limitations

Agent output can be wrong, incomplete, insecure, or destructive (for example edits to a linked folder on your drive). You must review code and use version control or backups before relying on results. We do not guarantee a specific quality of generated code or of third-party AI providers.

Billing

Paid plans renew according to Stripe checkout terms until cancelled. Taxes may apply. Refunds, if any, are handled case-by-case; contact scutiw@scutiw.com.

Disclaimer & liability

The service is provided “as is.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. Without limiting the foregoing, we are not liable for: loss of project files or keys on your device; unauthorized access to locally stored API keys; charges or actions by third-party AI providers; or damages from agent-generated code. Our total liability for any claim related to the service is limited to the greater of fees you paid us in the 3 months before the claim or $50.
