Terms of Service

The service

Agentic Build helps you create and edit software projects (often web apps) with an AI agent, optional live preview for simple static sites, and tools to save or open folders on your computer. Features may change as we improve the product. Durable project files are intended to live on your local drive (Save to folder, Download ZIP, or desktop “open folder” / linked folder). We do not guarantee cloud backup or long-term hosting of your project trees. Temporary cloud workspaces may be lost on redeploy or instance restart.

Accounts

You must provide accurate account information and keep your credentials secure. You are responsible for all activity under your account, including use of AI models with your keys or a paid plan. Free plans require you to supply your own LLM API keys where applicable. Pro ($20/month, when billed) may use our AI capacity subject to fair use, configuration, and availability.

Bring-your-own (BYO) API keys & secrets

If you use BYO models, you authorize Agentic Build to store, retrieve, and use your API key and related settings (model id, base URL, profile name) so the service can call third-party AI providers on your behalf and at your direction.

• Storage — when you are signed in and accounts / database are configured (for example production on Vercel + Neon), encrypted BYO settings may be stored in our database associated with your account so they can survive app redeploys and multi-instance hosting. Local or desktop installs may also keep encrypted settings on the machine running the app. Encryption reduces risk; it does not eliminate it.
• You own the risk of keys and spend — API keys are secrets that can incur real charges with third parties. You are solely responsible for: who may use your account; key selection, rotation, and revocation; provider billing, rate limits, and quotas; and monitoring usage. We do not guarantee that keys will never be lost, misused, or accessed through account compromise, software bugs, hosting failures, or third-party attacks.
• No liability for key-related loss — to the fullest extent permitted by law, Agentic Build and its operators are not liable for any charges, losses, stolen or leaked API keys, unauthorized model usage, lost tokens, provider account suspension, or any direct or indirect damages arising from your decision to store or use BYO keys (or any other secrets) with the product.
• Third-party providers — prompts, code, images, and other content you send may be transmitted to your chosen AI provider. Their terms and privacy policies govern that processing. We are not those providers’ agents for billing or data handling. We are not liable for provider outages, model errors, content policies, data retention, or billing on your provider account.
• What not to submit — do not send secrets, regulated data, or other materials you cannot afford to expose to a third-party model unless you accept that risk. Do not paste other people’s keys without authorization.

Subscriptions & plan detection

Paid plan status (for example Free vs Pro) is determined from our account records and payment processor (Stripe) data—such as checkout completion, subscription renewals, cancellation, and past-due status. Access to hosted (platform) AI, if any, depends on a valid plan and our server configuration (for example whether platform API keys are configured for the deployment).

• Plan status is separate from BYO keys. Having a subscription does not make us responsible for your third-party key spend, and saving a BYO key does not create a subscription with us.
• You must cancel in the billing portal (or as otherwise directed) to stop renewals. Taxes may apply. Refunds, if any, are handled case-by-case via the contact form.
• We are not liable for delays or inconsistencies in plan display caused by webhook/network delays, failed payments, or third-party billing systems—update payment details promptly if charged again after a change.

Your content & ownership

You own the apps and files you create. You grant us a limited license to process content as needed to run the product for you (including the agent and preview) on the systems you use. You must not use the service for illegal content, malware, abuse, or to violate others’ rights. You are responsible for backing up your work to your own disk or repositories; temporary working copies may be lost if you do not Save to folder / export.

AI limitations

Agent output can be wrong, incomplete, insecure, or destructive (for example edits to a linked folder on your drive). You must review code and use version control or backups before relying on results. We do not guarantee a specific quality of generated code or of third-party AI providers.

Billing (our product fees)

Paid plans for Agentic Build renew according to Stripe checkout terms until cancelled. That billing is separate from any fees your AI API provider charges against a BYO key. Taxes may apply. Refunds, if any, for our product fees are handled case-by-case via the contact form.

Disclaimer & limitation of liability

The service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. Without limiting the foregoing, we are not liable for:

• Loss, corruption, or disclosure of project files, chat history, or preferences;
• Loss, theft, misuse, rotation failure, or unauthorized use of API keys, tokens, or other secrets you store or enter;
• Charges, fees, suspensions, or damages billed by AI providers, cloud hosts, or other third parties tied to your keys or usage;
• Outages, model errors, or data handling by third-party AI providers;
• Damages from agent-generated code, automated edits, or your reliance on AI output;
• Interruption from Vercel, Neon, Stripe, email, DNS, or other infrastructure.

Our total liability for any claim related to the service is limited to the greater of (a) fees you paid us for Agentic Build in the three (3) months before the claim or (b) fifty U.S. dollars ($50). We are not liable for third-party AI provider fees under any circumstances. Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the maximum extent permitted.
